What Is A Ground Lease?

A Ground Lease enables property owners and developers to convert the value of their land into immediate, non-dilutive cash without incurring additional debt or relinquishing control of their operations. Fundamentally, this is a land sale combined with a long-term leaseback.

Ground Lease General Terms:

  • Term: Up to 99 years with possible extensions.
  • Base rent is typically negotiable depending upon interest rates and land value.
  • Rent may reset every 10 years, adjusted for inflation.
  • Annual rent increases by approximately 2% of the base rent. (For example, initial 6% rent of land value in the second year would be 6.12%)
  • The landowner usually retains the first lien on the land, and the building owner or bank retains the first lien on improvements.
  • The tenant generally covers all property expenses—including taxes, insurance, maintenance, and utilities.
